Duty to consult
(1) An employer must consult with workers and their representatives:
(a) about matters that are likely to affect their health or safety at work; and (b) about the introduction or making of a major change to any aspect of work that is likely to affect their health or safety at work.
(2) The consultation must be:
(a) effective; and (b) genuine; and (c) in a manner that provides the workers with a reasonable opportunity to express their views; and (d) in writing, unless exceptional circumstances apply.
(3) The employer must have regard to any views expressed by workers or their representatives as a result of the consultation.
